About Copyright and Our Photos of You
It’s important to realise who owns the photos we take and what your rights are regarding those photos. Here’s a simple, easy to understand summary…
- Our photographs are licensed just like software or any other intellectual property
- We always retain all copyrights as originators of the images we create.
- Personal clients are granted access to their photos for viewing and selection purposes and must purchase copies of their photos as prints or digital media. Prints are considered non-reproducable and unauthorised reproduction is copyright theft. Digital media are supplied at a size suitable for printing at any size up to a given maximum.
- We normally grant commercial clients an exclusive non-transferrable license to use the images for any personal or commercial purpose in all territories and across all media for an unlimited term, for a license fee.
- Non-payment of fees is considered a cancellation of any license granted.
- Unless otherwise stated at the time the photos are taken, we retain all rights to use the images for portfolio and marketing purposes. This excludes boudoir shoots which are by definition private and confidential – no boudoir photos shall be shown publicly without prior permission of the client.
